Broadband Terms & Conditions

Payment must be made by either Credit Card, Debit Card or Standing Order.

Standard Lead Time

Installation usually takes 5 working days from acceptance of the order by BT.

Conversion Lead Time

To convert from ISDN to ADSL, the ISDN must first be ceased. The ISDN terms and conditions will state the notice period required to cease the service. Once this cease has taken affect it takes 5 days to provision your IPstream order. The cost of doing this is the standard activation fee. As long as the ISDN has no penalty charges for ceasing then there is nothing else to pay.

Migration Lead Time

The lead time for service provider to service provider migration is 15 working days.

£35 admin charge for service provider to service provider migration.

Terms and Conditions

a. Acceptance:
KC3.net will contract to provide the service when British Telecommunications confirm that an ADSL service can be delivered to the location specified in the ADSL set up requirements form and the set up and first months payment has been received. They will confirm this by sending a technical information sheet with the set up details and installation date (effective date).
The customer shall be deemed to have accepted the service when the service is ordered.

b. Usage:
The ADSL service provides a fast permanent connection to the Internet it is not designed to be used as a part of a Web Hosting Service and if it is used for this purpose KC3.net cannot support the ADSL service.
The customer warrants and undertakes that they shall in their use of the service comply with KC3.net's acceptable usage policy which may be found on the KC3.net website (www.KC3.net), any relevant legislative and regulatory provisions and shall not use the services for any illegal purpose and shall indemnify KC3.net in respect of any liability incurred as a result of a breach of this clause.
Mass emailing and or the use of mass email programs is not allowed and may result in suspension of the account.

c. IP Addresses:
IP addresses assigned by KC3.net will be returned to KC3.net when the related service ceases.

KC3.net work under the auspices of RIPE allocation of IP addresses and may only provide IP addresses to the customer if they adhere to the RIPE terms and conditions

d. Service

KC3.net warrants to the customer that it will provide all the services ordered with reasonable care and skill but does not guarantee that this will cause the services to operate without fault or interruption.
In the event of a fault or interruption of service KC3.net will provide full support Monday to Friday 09000 to 1700 and KC3.net server core Network support 24 by 7.
In the event of the customer's hardware failure, the contracted services is still available and therefore chargeable at standard rates.
KC3.net cannot make any guarantees for service provided by a third party.
e. Contract length:
12 months from the effective date.

f. Cancellation period:
Contracts are for 12 months and then after that first 12 months 1 months notice in writing must be given to cancel the contract. (Example: KC3.net receive a request to cancel the contract at end of month 12 then contract would terminate 1 month later at the end of month 13.)

g. Payments and VAT:
The customer agrees with KC3.net to pay all charges, VAT and any bank charges that may arise when they fall due.

h. Data Protection:
In the case of any customer who is an individual about whom KC3.net processes personal data (as defined by the Data Protection Act), KC3.net may use such data to provide the customer with details of other KC3.net products which may be of interest to the customer.
KC3.net will accept liability without limitation for death or personal injury resulting from the negligence of KC3.net, its employees or agents, or subcontractors for which KC3.net is responsible. In all other circumstances KC3.net shall not be liable for loss of profits, business, revenue, goodwill or anticipated savings, or for special indirect or consequential loss or any loss arising from any claim made by the customer or made against the customer by any other person.

i. Liability:
In the event of a dispute between the parties concerning this contract each of the parties, shall in the first instance bring the dispute at the earliest opportunity to the attention of a Director or similar officer.
All contracts are governed by and constructed in accordance with English Law and the parties irrevocably agree to the exclusive jurisdiction of the English courts.
